Buying
An Agreement of Purchase and Sale, once accepted, is a binding legal contract between the buyer and the seller. Our lawyers can review this contract with you before signing to determine that your individual interests are adequately protected.
In representing buyers, our most important responsibility is to ensure that you have “good title” to the property that you purchase. “Good title” means that you truly own the property you have purchased because the property is accurately described, properly registered and no one else has a claim to the property that you do not know about. Good title means that your ownership in the property is indisputable and that should you choose to sell or refinance your property in the future, you will be able to do so without legal difficulty.
As part of this process, our lawyers will:
- Confirm that the vendors have a right to sell you the property and that no one else has a claim to or lien on the property;
- Consider boundary issues, such as whether there is an encroachment;
- Advise you of any additional interests in your property, such as restrictions on property use or easements for utility companies.
Our lawyers will explain all aspects of the real estate transaction to you. If we uncover any problems that could affect your home purchase, our lawyers will take steps to fix them. In the event that such matters cannot be resolved, our lawyers will explain the risks of buying the property without resolving them so that you can make an informed decision.
